European leaders highlighted common culture, commitments to rule of law, institutional transparency, and freedom of expression. Yet, scarcely weeks after these diplomatic engagements, another development has cast a troubling shadow over that narrative. The conviction of an independent journalist in India has reignited serious concerns about the state of press freedom in the country. In Europe, where legal frameworks largely safeguard journalists and protect freedom of speech as a cornerstone of democracy, such developments are deeply unsettling. The contrast raises pressing questions about whether fundamental freedoms particularly press freedom are receiving the same protection in India as they are expected to in mature democracies.

In a verdict that has sent shockwaves through India’s media landscape, independent journalist Ravi Nair was convicted on February 10, 2026, by a magistrate court in Mansa, Gandhinagar, Gujarat, in a criminal defamation case filed by Adani Enterprises Limited (AEL), the flagship company of the sprawling Adani Group. Nair, known for his relentless scrutiny of corporate giants and their ties to political power, was sentenced to one year of simple imprisonment and fined ₹5,000. This case, stemming from a series of tweets and articles published between October 2020 and July 2021, exemplifies how powerful conglomerates like Adani are weaponizing outdated colonial-era laws to muzzle dissent, raising alarms about the precarious state of journalism and freedom of speech in the world’s largest democracy.

Nair’s “crime”? Posting critical commentary on social media platform X (formerly Twitter) and contributing to the independent watchdog site AdaniWatch.org. His pieces questioned the Adani Group’s alleged political patronage, financial irregularities, unethical practices, manipulation of environmental regulations, and links to offshore entities tied to controversial figures. For instance, Nair highlighted reports on Adani’s bids for assets like the Dewan Housing Finance Corporation (DHFL), potential favoritism in natural gas reforms, and environmental concerns surrounding projects like a proposed coal power plant in Madhya Pradesh. He also raised pointed questions about why certain fugitives, such as diamond merchant Jatin Mehta, allegedly linked to the Adani family, had not been extradited, implying protection through high-level connections.

The court, in its 55-page judgment, dismissed Nair’s defense that his posts constituted fair criticism or public interest journalism. The ruling emphasized that freedom of speech under Article 19(1)(a) of the Indian Constitution is not absolute and must not infringe on the right to reputation under Article 21. Nair, who has announced plans to appeal, described the verdict as a “dangerous precedent” that could deter investigative reporting on corporate malfeasance. Click here to read.

This conviction is not an isolated incident but part of a broader pattern of legal harassment by the Adani Group, led by billionaire Gautam Adani, whose close ties to Prime Minister Narendra Modi have long been scrutinized. Reporters Without Borders (RSF) has labeled the Adani Group a “press freedom predator,” accusing it of waging an “unprecedented legal war” against journalists since 2017. The conglomerate has filed at least 10 lawsuits against over 15 journalists and media outlets, combining civil and criminal defamation claims to silence critics. In 2025 alone, Adani secured ex-parte gag orders in Delhi courts, leading to the removal of content from platforms like YouTube and Instagram, affecting outlets such as The Wire, Newslaundry, and independent voices like Ravish Kumar. These “SLAPP” suits (Strategic Lawsuits Against Public Participation) are designed not necessarily to win but to exhaust defendants through protracted legal battles, where the process itself becomes the punishment.

India’s press freedom ranking has plummeted under the Modi administration, slipping to 159th out of 180 countries in the 2025 World Press Freedom Index by RSF. Criminal defamation laws, retained from the British-era Indian Penal Code (Sections 499 and 500), allow for up to two years’ imprisonment – a relic that stands in stark contrast to most democracies, where defamation is treated as a civil matter. The Committee to Protect Journalists (CPJ) has condemned Nair’s sentencing as setting a “dangerous precedent,” arguing it stifles public interest reporting and deters scrutiny of powerful actors. “Laws that allow imprisonment for defamation are being misused to prevent legitimate journalism,” said CPJ’s Asia Program Coordinator Kunal Majumder.

The Adani Group’s aggressive tactics extend beyond Nair. In September 2025, a Delhi court issued an injunction against nine journalists and platforms, including Nair himself, restricting “unverified and defamatory” content a broad order that was later partially quashed but highlighted the ease with which corporations can obtain ex-parte relief. The Ministry of Information and Broadcasting, citing such orders, mandated the takedown of 138 YouTube videos and 83 social media posts critical of Adani. This censorship, often executed without hearings, echoes a chilling effect seen in other cases, such as the Adani Group’s acquisition of NDTV in 2022, which marked the end of one of the last bastions of independent mainstream media.

Nair’s story is emblematic of the threats facing Indian journalists. A veteran reporter who contributed to outlets like The Wire, NewsClick, and Frontline, and co-authored a 2025 Washington Post exposé alleging state-backed financial support to Adani via the Life Insurance Corporation of India (LIC), Nair has faced relentless pressure. His work uncovered alleged offshore networks, monopolistic practices, and environmental destruction by Adani projects. Yet, instead of addressing these allegations substantively, Adani has opted for litigation, a strategy that critics say protects opaque business dealings while eroding democratic accountability.

The Committee to Protect Journalists (CPJ) expressed concern after Indian journalist Ravi Nair was sentenced to one year in prison in a criminal defamation case linked to his reporting on the Adani Group, February 11, 2026.

Public reaction on social media has been polarized. While some users celebrated the verdict as a win for “responsible reporting,” others decried it as an assault on free speech, with posts warning that “speech is free, but consequences are expensive” when challenging the powerful. Supporters of Nair, including the Editors Guild of India and the International Federation of Journalists (IFJ), have called for the decriminalization of defamation and protections against SLAPPs. “This verdict underscores how corporate might, intertwined with political influence, is suffocating journalism,” said an IFJ spokesperson.

As India hurtles toward its Vision 2047 economic goals, the Adani Group’s dominance in sectors like ports, energy, and infrastructure often bolstered by government contracts demands transparency. Yet, cases like Nair’s suggest that questioning this nexus comes at a steep personal cost. If journalism is the fourth estate, then in Modi’s India, it is increasingly under siege, not by overt censorship, but by the subtle terror of endless courtrooms. Without urgent reforms, the voices holding power to account may soon fall silent, leaving citizens in the dark about the true cost of unchecked corporate ambition.

India (Helvilux / India Correspondence Kashiram Vichare) – As European Commission President Ursula von der Leyen and her delegation recently signed EU INDIA Trade deal and concluded high-level discussions in India, much emphasis was placed on shared democratic values, mutual trust and strategic cooperation.
